HUNT AGREEMENT, WAIVER & POLICIES

Effective Date: The date of purchase

1. Scope of Agreement

This Agreement governs all services and activities provided by Disston Turkey Hunt Co (“Company”), including but not limited to:

• Guided Osceola turkey hunts

• Hog hunts

• Fishing or boating excursions

• Use of blinds, tree stands, vehicles, ATVs, boats, or equipment

• Lodging and meal accommodations (if selected)

• Any other activity offered by the Company

By booking any service, Client agrees to all terms contained herein.

Wildlife is unpredictable. Harvest is not guaranteed.

2. Covered Parties

This Agreement releases and protects:

• Disston Turkey Hunt Co

• Townsend Landtrust, LLC

• Property owners

• The Administrator

• Guides and assistant guides

• Independent contractors

• Lodging hosts and lodging property owners

• Employees, agents, and representatives of the above

(collectively referred to as the “Released Parties”).

3. Assumption of Risk

Client understands that hunting and outdoor recreational activities involve inherent risks that may result in injury or death.

These risks include, but are not limited to:

• Firearms and ammunition

• Wildlife encounters

• Elevated blinds or tree stands

• ATVs and vehicles

• Boats and water hazards

• Uneven terrain, wetlands, and wooded areas

• Weather conditions

• Insects, reptiles, and other natural hazards

Client voluntarily assumes all known and unknown risks associated with participation in any Company activity.

4. Release & Hold Harmless

Client releases and holds harmless the Released Parties from claims, liabilities, damages, or causes of action arising from participation in Company activities, except in cases of gross negligence or intentional misconduct.

This release applies to hunting, lodging, transportation on property, boating, equipment use, and any additional activity offered by the Company.

5. Alcohol & Controlled Substances

Disston Turkey Hunt Co recognizes that hunting trips are often social experiences, and responsible alcohol consumption may be permitted during non-hunting hours.

However, no participant may engage in hunting activities, handle firearms, operate ATVs or boats, or participate in any guided activity while impaired.

Client agrees to exercise sound judgment and personal responsibility. If a guide or Company representative reasonably believes a participant is impaired or acting in an unsafe manner, the Company reserves the right to delay, suspend, or terminate participation for safety reasons.

Any injury, damage, or loss arising from impairment or misconduct shall be the sole responsibility of the participant.

Illegal drugs or misuse of controlled substances are prohibited at all times.

6. Additional Activities

If Client elects additional activities — including hog hunting, fishing, boating excursions, or other add-ons — those activities are fully covered under this Agreement and subject to the same assumption of risk and release provisions.

7. Lodging & Host Liability

If lodging accommodations are provided:

• Client is responsible for personal conduct

• Client is responsible for any damage caused

• Lodging hosts and property owners are included as Released Parties

Client assumes all risks associated with lodging facilities and related premises.

8. Compliance with Law

Client is solely responsible for obtaining:

• Valid Florida hunting license

• Required turkey permit or tags

• Any additional required permits

Client agrees to comply with all Florida Fish & Wildlife Conservation Commission (FWC) regulations and all applicable laws.

9. Refund Policy

Booking deposits are non-refundable.

If weather conditions make hunting unsafe, Company may, at its discretion:

• Reschedule the hunt

• Apply credit toward a future hunt

• Issue a partial refund minus lodging or incurred expenses

No refunds will be issued for lack of harvest, missed opportunities, early departure, or voluntary cancellation outside stated policy.

10. Media Release

Client grants permission for reasonable use of photographs or video taken during the hunt for promotional purposes unless declined in writing prior to the hunt date.

11. Indemnification

Client agrees to indemnify and defend the Released Parties against claims arising from Client’s negligence, misconduct, or violation of law.

12. Transportation & Vehicle Responsibility

Client is solely responsible for the operation and condition of their personal vehicle(s) while traveling to, from, or within Company property.

The Released Parties are not responsible for:

• Damage to Client vehicles

• Theft or loss of property

• Accidents occurring on or off Company property

• Incidents occurring after departure from Company premises

Client acknowledges that fatigue, weather conditions, or personal decisions made after participation are solely the responsibility of the Client.

13. Governing Law & Venue

This Agreement shall be governed by the laws of the State of Florida.

Any dispute shall be resolved in Flagler County, Florida.

14. Acknowledgment

By completing a purchase, Client acknowledges that:

✔ They understand the risks involved

✔ They voluntarily agree to all terms

✔ They accept full responsibility for their conduct
